Strengthening Your Easement With an Amendment

If you donated your easement years ago, recently purchased land in easement, or your family has expressed an interest in more protection than your current easement provides, you might consider an easement amendment.

A conservation easement is a legal agreement not to exercise certain rights of subdivision and/or development, but often, the donor will reserve rights for limited future growth. If the landowner decides that those rights are no longer necessary, the reserved rights can be donated in an easement amendment. The value of that amendment is eligible for all the benefits provided for conservation easements.
